Jakarta – The 20-year prison sentence was not only imposed on the defendant Harvey Moeis, but also on the defendant Mochtar Riza Pahlevi Tabrani, the President Director of PT Timah. This was read by the panel of judges of the Jakarta High Court in the verdict of the prosecutor’s legal appeal regarding the tin corruption case on Thursday, February 13, 2025.
“Imposing a sentence on the defendant Mochtar Riza Pahlevi Tabrani, therefore, with a prison sentence of 20 years,” said Chief Judge Catur Iriantoro at the Jakarta High Court, Cempaka Putih, Central Jakarta.
Mochtar Riza was also fined Rp1 billion, with the stipulation that if it is not paid, it will be replaced with 6 months of imprisonment.
“Sentencing the defendant to pay compensation for state financial losses amounting to Rp493 billion, with the provision that if the convicted person does not pay the compensation within one month after the decision becomes legally binding, their assets may be seized by the prosecutor and auctioned to cover the compensation,” said Judge Catur.
“If the convicted person does not have sufficient assets to pay the replacement money, they will be sentenced to six years in prison,” he continued.
Previously, the Panel of Judges of the Central Jakarta Corruption Court sentenced the defendant Mochtar Riza Pahlevi Tabrani, the President Director of PT Timah Tbk, to 8 years in prison in connection with the tin corruption case. In addition, the defendant Emil Ermindra, as the Finance Director of PT Timah Tbk, also received a similar verdict.
“Sentencing the defendants Mochtar Riza Pahlevi Tabrani and Emil Ermindra to eight years in prison each and a fine of Rp750 million, with the condition that if the fine is not paid, it will be replaced with six months of imprisonment,” said the judge at the Central Jakarta Corruption Court, Monday (30/12/2024).
Meanwhile, for the defendant MB Gunawan, as the President Director of PT Stanindo Inti Perkasa, a sentence of five years and six months in prison was imposed.

“Imposing a sentence on the defendant MB Gunawan, therefore, with a prison term of five years and six months and a fine of Rp500 million, with the provision that if the fine is not paid, it will be replaced with an imprisonment term of four months,” the judge explained.
As for the burden of replacement money on the defendants Mochtar Riza Pahlevi Tabrani and Emil Ermindra, the judge stated that both were not proven to have obtained results or wealth sourced from tin corruption crimes.
“To the defendants Mochtar Riza Pahlevi Tabrani and Emil Ermindra, no restitution payment is imposed,” the judge emphasized.
The sentence given by the judge was lighter than the prosecutor’s demand, namely Mochtar Riza Pahlevi Tabrani and Emil Ermindra were sentenced to 12 years in prison and a fine of Rp1 billion, with a subsidiary of one year in prison, as well as a replacement amount of Rp493 billion with a subsidiary of six years in prison.
Meanwhile, the defendant MB Gunawan is charged with eight years in prison and a fine of Rp750 million, with a six-month substitute sentence.
