Jakarta – Crazy rich Surabaya Budi Said has been sentenced to 16 years in prison in the case of alleged corruption in the manipulation of Antam gold sales. He is also required to pay a replacement fee to the state amounting to Rp1.108 trillion.
“To impose a sentence on the defendant Budi Said, therefore with a prison sentence of 16 years, reduced by the time the defendant has been in temporary detention with the order that the defendant remains detained in the detention center,” said the prosecutor from the Attorney General’s Office (Kejagung) while reading the indictment at the Central Jakarta Corruption Court on Friday (13/12/2024).
In addition to imprisonment, the prosecutor also demanded a fine of Rp1 billion from Budi Said. If not paid, it will be replaced with a 6-month imprisonment.
The prosecutor also imposed a restitution obligation on Budi Said, consisting of two forms totaling Rp1.108 trillion.
First, for gold weighing 58.135 kilograms (kg) or equivalent to Rp35 billion. This value is based on the excess gold received by Budi Said from his gold purchases at BELM Surabaya 01 Antam.
Second, for gold weighing 1.136 kg or 1.1 tons equivalent to Rp 1.07 trillion. This value is derived from Budi Said’s civil lawsuit against Antam for the shortfall in the gold delivery he received from his transaction with the state-owned enterprise.
According to the prosecutor, the amount of Rp 1.07 trillion is based on the cost price of Antam’s gold production as of December 2023, as calculated by the Financial and Development Supervisory Agency. (BPKP).
“Or at least equivalent to the value of gold at the time of execution, taking into account the provision funds that were frozen in PT Antam Tbk’s financial report as of June 30, 2022, amounting to IDR 952.4 billion based on the Supreme Court’s (MA) decision,” the prosecutor stated, as quoted from the written statement.
Given One Month

All the replacement money must be paid by Budi Said within one month after his legal case becomes legally binding. If not replaced, the prosecutor will seize some of his assets to cover the replacement money.
“In the event that the defendant does not have sufficient assets to pay the replacement money, he will be sentenced to 8 years in prison,” the prosecutor continued.
In this case, the prosecutor is convinced that Budi Said has been proven to have committed corruption related to his gold transactions at Antam, which were carried out jointly and continuously.
The prosecutor believes that Budi’s actions have violated Article 2 paragraph 1 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes in conjunction with Article 55 paragraph 1 sub-paragraph 1 in conjunction with Article 64 paragraph 1 of the Criminal Code as stated in the primary first indictment.
“And committed money laundering as stated in the second primary cumulative charge as regulated and punishable under Article 3 of Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes (TPPU),” the prosecutor stated.
Aggravating and Mitigating Factors
Previously, the prosecutor read out the aggravating and mitigating factors regarding the defendant as considerations for the charges.
Aggravating factors, the defendant’s actions caused financial losses to the state at PT Antam amounting to 152.80 kg of gold or equivalent to Rp 92.2 billion and 1.1 tons of Antam gold or equivalent to more than Rp 1 trillion.
In addition, Budi Said has used the proceeds of his crime by committing money laundering, the defendant did not support the government’s program aimed at maintaining a clean and corruption-free state, and the defendant denied all the criminal acts he committed and did not regret his wrongdoing.
“Mitigating factors, the defendant has never been convicted, the defendant has behaved politely during the trial,” he added.
