The prosecutor has not yet taken a stance on Harvey Moeis’s 6.5-year prison sentence.

The public prosecutor (JPU) has not yet taken a stance on the verdict of the Corruption Court judges at the Central Jakarta District Court against Harvey Moeis, who was sentenced to a light punishment of 6.5 years in prison. The husband of artist Sandra Dewi is one of the defendants in the alleged tin trading corruption case in the mining business area of PT Timah Tbk from 2015-2022.

The Head of the Legal Information Center of the Attorney General’s Office, Harli Siregar, stated that the Public Prosecutor has seven days to decide, either to file an appeal or accept the verdict of the panel of judges after the verdict is read. It is known that the verdict against Harvey was read on Monday (23/12).

“(This) is still within the contemplation period. According to procedural law, the prosecutor has seven days after the court’s decision to consider whether to appeal or accept the verdict,” said Harli in a written statement on Thursday (26/12).

“So we wait for the prosecutor’s stance.” If there is already a stance from the prosecutor, we will update it,” he continued.

In the series of trials, the prosecutor demanded that Harvey be sentenced to 12 years in prison with a fine of Rp1 billion and an additional penalty in the form of replacement money of Rp210 billion. The judge imposed the fine and additional penalty of replacement money as demanded by the prosecutor.

Harli explained that the magnitude of the demand was considered by the prosecutor based on legal considerations, including aggravating and mitigating factors. Harvey was convicted of violating Article 2 paragraph (1) in conjunction with Article 18 of the Anti-Corruption Law and Article 3 of the Money Laundering Prevention and Eradication Law in conjunction with Article 55 paragraph (1) sub-paragraph 1 of the Criminal Code.

The state losses caused by Harvey’s actions along with other defendants amounted to Rp300 trillion. The figure consists of the excessive rental cost of smelting equipment, which is Rp2.284 trillion, payment for tin ore from IUP Rp26.648 trillion, and environmental damage amounting to Rp271.069 trillion.
